Terms and conditions
Registration
All information that is completed and provided by you, such as; Application and registration forms, medical certificates or other documents must be true, correct and complete. We would be very grateful if you notify us of any changes to this information.
Registration confirmation and verification
Once you have received the necessary documents for your registration and participation, and your payment has also been recorded, you will receive a confirmation from us within the next 15 days. If you do not receive any confirmation from us, or if you discover errors or omissions in it, please contact info@mayanchannelswim.com
Transfer of registration and participation to a third party
In the event that the applicant swimmer, for personal reasons, decides not to participate in the requested slot, but had already completed the corresponding registration and initial payment process, he or she may transfer it to a third party, as long as the latter also meets the required profile. and with the documentation required by Mayan Channel Swim. with the understanding that the remaining balance to be paid will be covered by the substitute third party.
Right of withdrawal and refund
In case of withdrawal by the applicant swimmer, he/she will lose 50% of the advance payment made to reserve his/her slot. The only reimbursement to which you will be entitled will be the subsequent payments to such advance payment if they have been made.
This policy applies until 30 days before the first day of the start of the slot assigned to the swimmer; from which if the swimmer cancels, he will be entitled to a voucher of $1,400 USD to be applied to a rescheduled crossing with the same specifications and services within one year.
Payment
Payment may be made in a single installment, or failing that, in up to 3 installments. When payment is made in installments, the first will necessarily have to cover 50% of the value of the crossing.
Additional costs
The price and value of the crossing is planned so that it takes a maximum of 7 hours and 30 minutes and on a route between 27 and 30 kilometers in distance with a minimum average speed of 3.5 km/hr. If the swimmer exceeds the estimated maximum time, he or she must cover the extra costs incurred for exceeding the stipulated time. This extra cost will be 200 usd per hour exceeded.
Responsibility
By registering, you confirm that participating and undertaking the open water activity with Mayan Channel Swim will be at your own risk and responsibility. Likewise, you confirm that neither the organizer, nor its partners, nor sponsors can be held responsible, legally and financially, for any type of accident, injury or death before, during and after the crossing.

Use of multimedia material
Photos, videos, interviews and similar multimedia material featuring participants in connection with Mayan Channel Swim may be freely used by organizers, partners and sponsors, including for marketing purposes. All photos used by the organizers both online and in printed material, including websites, YouTube, Facebook, Instagram, Twitter and other social media, will be subject to copyright and may not be used in any way for commercial or marketing purposes without consent.
Rights to the swimmer's multimedia material
If Mayan Channel Swim receives multimedia material from the swimmer, the swimmer grants unlimited access and use of it by the organization.
Cancellation and cases of force majeure
Mayan Channel Swim may be forced to cancel the crossing due to unforeseen circumstances or force majeure. Examples include, but are not limited to: orders and prohibitions by maritime authorities, storms, accidents and other circumstances beyond our control.
In the event that the crossing is canceled due to any of these circumstances, the swimmer may choose one of the following options:
- Reimbursement of 85% of the cost of the crossing. The remaining 15% will be to cover expenses and costs already accrued such as permits and insurance.
- Request a new space for next year which will be covered with 85% of the price already paid by the swimmer and will only pay 15% to cover new permits and insurance.
- If the swimmer has more days to stay in the Riviera Maya, he can choose to postpone his crossing at that time for another nearby day within their period of stay, as long as there is availability and ideal conditions.
Applicable legislation
For any dispute or claim arising from these terms and conditions, the contracting party and the Mayan Channel Swim organization will be subject to the Mexican legislation in force and applicable in Mexico City. The interpretation, application, compliance or non-compliance with the provisions of these Terms and Conditions will be governed under this same legislation, with the applicable jurisdiction being the Federal Courts of Mexico City, expressly waiving any other jurisdiction that may correspond to them in reason of their present or future addresses or for any other reason.
Changes to terms and conditions
Mayan Channel Swim reserves the right to change or modify its terms and conditions without prior notice. It is recommended to visit the website frequently to be aware of any changes or modifications.
